By accessing or using FloatOps Studio, you agree to be bound by these Terms of Service. If you do not agree, do not use the platform.
1. Acceptance of Terms
These Terms of Service ("Terms") govern your access to and use of FloatOps Studio, operated by QuickSoft Media ("we", "us", "our"). By creating an account or using the platform, you agree to these Terms.
2. Description of Service
FloatOps Studio is a cloud-based operations management platform for balloon safari operators. It includes a web application and the FloatOps Field mobile application for Android. The platform manages flight scheduling, guest bookings, transport coordination, weather decisions, and related operations.
3. Account Registration
To use FloatOps Studio, you must create an account. You are responsible for:
- Providing accurate and complete information during registration
- Maintaining the security of your account credentials
- All activity that occurs under your account
- Notifying us immediately of any unauthorised access
4. Subscription and Payment
FloatOps Studio is available on a subscription basis. Subscription fees are billed in advance on a monthly or annual basis. All fees are non-refundable except where required by law or as described in our 90-day guarantee for migrating customers.
We reserve the right to change pricing with 30 days' notice to existing subscribers.
5. Acceptable Use
You agree not to:
- Use the platform for any unlawful purpose or in violation of any regulations
- Share account credentials with individuals outside your organisation
- Attempt to gain unauthorised access to other tenants' data
- Reverse engineer, decompile, or disassemble any part of the platform
- Use the platform to store or transmit malicious code
- Overload or disrupt the platform's infrastructure
6. Data Ownership
You retain ownership of all data you enter into FloatOps Studio, including guest records, flight data, and booking information. We do not claim ownership of your operational data. You grant us a limited licence to store, process, and display your data solely to provide the service.
7. Availability and Uptime
We aim to maintain high availability but do not guarantee uninterrupted access. Scheduled maintenance will be announced in advance where possible. The FloatOps Field mobile app includes offline caching to support field operations during connectivity outages.
8. Limitation of Liability
To the maximum extent permitted by law, FloatOps Studio and QuickSoft Media shall not be liable for indirect, incidental, special, or consequential damages arising from your use of the platform, including operational decisions made based on data displayed in the system.
Our total liability to you for any claim shall not exceed the amount you paid for the service in the 12 months preceding the claim.
9. Termination
Either party may terminate the subscription with 30 days' written notice. We may suspend or terminate your account immediately for material breach of these Terms. Upon termination, you may export your data during the 90-day retention window.
10. Governing Law
These Terms are governed by the laws of Tanzania. Disputes shall be resolved through good-faith negotiation. If unresolved, disputes shall be subject to the jurisdiction of the courts of Arusha, Tanzania.
11. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes 30 days in advance. Continued use of the platform after changes take effect constitutes acceptance.
